Study finds hiring bias against older Americans

New York job seekers may be interested to learn that some older Americans have trouble getting hired potentially due to age bias. Although there are laws that prevent employers from explicitly discriminating against employees based on age, some companies may attempt to get around this by using certain recruiting tactics.

For example, a tobacco company attempted to avoid hiring older Americans by limiting its candidate search to individuals who were less than two to three years out of college. Additionally, potential candidates who had at least eight years of experience were to be avoided. Of about 1,000 employees who were hired, only 19 were at least 40 years of age. A job recruiter ultimately became a whistleblower and gave the hiring guidelines to an attorney, starting the lawsuit process against the company.

This is not an isolated incident. According to a study in which 40,000 identical resumes with differing ages were sent out to companies, the number of call-backs for interviews dropped as the age listed on the resume got higher. This meant that older Americans were less likely to get an interview than younger Americans.

Employment discrimination can prevent eligible candidates from being able to secure a job and pay their bills. If there is evidence that an employer discriminated against a potential applicant due to the applicant's age, a lawsuit might be in order. An attorney may assist with seeking evidence that shows a pattern of not hiring certain applicants based on their age. The attorney may help clients obtain the position they would have been hired at if they had not been discriminated upon.
