Many workers struggle with wage discrimination

Wage discrimination can be experienced by workers in New York for a number of reasons. While gender is a major example, wage discrimination can be experienced by both women and men. Older workers and workers with disabilities have also reported wage discrimination on the job.

The Equal Employment Opportunity Commission reports on the charge filings it has received alleging wage discrimination. While the majority of these filings based on gender over the past four fiscal years were filed by women, approximately 15 percent of them were filed by men.

However, the landscape of wage discrimination complaints isn't limited to concerns about gender. While gender-based claims are filed under the Equal Pay Act as well, most claims about racial, national origin, religion, age or disability discrimination are filed under Title VII of the 1964 Civil Rights Act. The overall number of complaints filed has remained relatively stable, with over 5,000 complaints being filed each fiscal year from 2013 to 2016. Workers experience wage discrimination in multiple contexts and pay disparities continue among many different groups. Race and age are also leading causes.

Employers that have 100 or more employers must file an annual form, the Employer Information Report, which provides demographic information about their workplace. This form was updated to require mandatory pay data about different categories of jobs. This information can also help to empower federal efforts to respond to this type of employment discrimination.

Wage discrimination can hurt not only affected workers but their family members as well. People who have been the victims of this type of discrimination might want to meet with an employment law attorney in order to see what recourse might be available.
