Many employees do not report sexual harassment

New York employees may be interested to learn that the majority of employees who have experienced sexual harassment at their workplace never reported the incident to their employer. A recent survey asked employees about their history with reporting harassment and whether the issue got resolved.

The results of the survey showed that about 12 percent of workers had experienced an incident of sexual harassment. Of these employees, 72 percent said that they did not report the incident to their employers. Further, 54 percent said that they did not confront the person who committed the act. The survey found that 60 percent of the perpetrators were peers while 36 percent were managers or supervisors. A further 8 percent were members of senior management.

While there were many employees who did not report the incidents, approximately 75 percent of those who did said that the issue was resolved. Employees who experience sexual harassment at work should be aware that the law is on their side as they are legally protected under the Civil Rights Act of 1964. Employees should follow their employer's guidelines when it comes to reporting the incident.

Although many employers do whatever they can to resolve issues regarding harassment and discrimination, there are others who may actually punish the employee for making the report. Punishments could potentially include demotion, a change in hours or wrongful termination. If an employee is punished and this result in a loss of income or benefits, an employment law attorney may assist in seeking a resolution with the employer. However, if a solution cannot be reached, the attorney may file a lawsuit against the employer. Depending on how the employee was punished, the attorney may seek compensation for income that was lost or compensation for lost benefits.
