Although the job market is currently considered particularly strong, many workers in New York and elsewhere who are over the age of 45 are often difficulty finding work. Many of these workers have said that this may be due to age discrimination.
According to a survey from the AARP, 61 percent of respondents said that they experienced age discrimination in the workplace or have seen age discrimination in the workplace. Approximately 38 percent of the respondents also said that they believed that the practice of age discrimination in the workplace was very common. Even so, only about 3 percent of the participants ever made an official complaint to their employers.
The survey also found that more than 50 percent of the respondents who said that they either experienced or saw age discrimination reported that they believed differential treatment began when workers reached the age of 50. About 25 percent of these respondents said that age discrimination played out at receiving negative remarks about their age from a supervisor or a colleague. Another 16 percent said that they had not gotten a job due to their age. Finally, 12 percent said that they were overlooked for a promotion due to their age.
Although harassment and discrimination based on age is illegal in U.S. workplaces, it can still happen. When age discrimination does occur, a person may find that it is difficult to move up within the company or even get hired. Even if a worker knows that discrimination or harassment is occurring, he or she may not be aware of his or her rights. As a result, a worker may not speak out due to the fear of losing his or her job. An employment law attorney may help a worker report incidents of age discrimination and work to seek compensation for income or benefits that the worker is entitled to.
