Discrimination in the workplace was still prevalent in 2019

Although preventing discrimination in the workplace is garnering significant attention, claims alleging legal violations are still prevalent in New York and across the nation. Agencies like the Equal Employment Opportunity Commission track these charges and file claims for victims to be compensated. The latest data lists the most common reasons for which claims were filed in 2019.

According to the EEOC, there were 72,675 claims of workplace discrimination for the fiscal year ending on Sept. 30, 2019. The most allegations were for retaliation followed by disability discrimination, racial discrimination and sex discrimination. There were more than 39,100 claims of retaliation. That is approximately the same number as for fiscal year 2018. For 2019, the EEOC found that an estimated 70% of the claims did not have reasonable cause. For valid claims, claimants received more than $205 million in compensation due to retaliation complaints.

Sexual harassment was a persistent issue, making up more than 10% of the charges with a total of more than 7,500. This was a decrease of 1.2% from the prior year. Of those 7,500, 54.6% were not found to have reasonable cause, and $68.2 million was paid in settlements for these allegations. That was an increase of around $12 million from 2018. In 2018, the EEOC filed 217 enforcement lawsuits, and in 2019, there were 157 lawsuits.
