Study looks at discrimination against LGBTQ entrepreneurs

Entrepreneurs in New York may have more difficulty raising startup capital if they openly identify as gay, lesbian or transgender, according to a new national study. A nonprofit group called StartOut looked at discrimination of LGBTQ entrepreneurs by investors in the business world. The study also examined how LGBTQ entrepreneurs deal with the discrimination that they face and whether they choose to remain closeted.

Federal judge rules dreadlocks not protected by law

New York workers might be interested in knowing about a workplace discrimination case involving dreadlocks at work. The ruling in this federal court case means that dreadlocks are not protected by federal anti-discrimination laws.

Misclassifying employees can lead to penalties

Federal regulators continue to scrutinize the practice of misclassifying people as independent contractors when they should be statutory employees. A string of decisions from the National Labor Relations Board should alert employers in New York to the importance of meeting legal standards when classifying workers. A recent memorandum addressing the problem called one employer's designation of truck drivers as contractors an impediment to the workers' ability to exercise their Section 7 rights under Section 8(a)(1).

Associational disability discrimination prohibited

New Yorkers who have disabled children or other family members may not be discriminated against at their workplaces based on the relationships they have with them. This form of discrimination is called associational disability discrimination, and it is prohibited under the federal Americans with Disabilities Act.

Legal protections for pregnant employees and new mothers

Under the provisions of the Family and Medical Leave Act, a worker in New York can take up to 12 weeks of unpaid leave after giving birth. Upon returning to work, the worker should expect reinstatement to the same or equivalent position.
